A jury convicted defendant Gregory Allen Sturm of the first degree murders of Darrell Esgar, Chad Chadwick, and Russell Williams (Pen. Code, 187), among other offenses, and found true the special circumstance allegations that defendant committed multiple murders (190.2, subd. (a)(3)) and that each murder was committed during the commission of a robbery (190.2, subd. (a)(17)(i), 211). After a penalty phase mistrial, a second jury determined that the death penalty should be imposed. This appeal from the resulting judgment is automatic. (1239, subd. (b).) For the reasons that follow, we affirm defendants convictions, but reverse the death sentence.
